All Programs, Products, and Services on this website are owned and operated by Erica Ballard.

By using any of these Programs, Products, or Services, you agree to these Terms of Use as they appear, and are legally bound by them, whether you have read them or not. If at any time you do not agree with these Terms of Use, please do not use these Programs, Products, or Services.

By booking a session or event, or completing a purchase through this website, you are confirming that you have read, understood, and agree to be bound by these Terms of Use as well as the Disclaimer and Privacy Policy, and any other terms and conditions that may apply, and you are required to act in accordance with them.

All Programs, Products, Services, and Program Materials are intended solely for users who are eighteen (18) years of age or older. Any registration by, use of, or access to any Program, Product, Service, or Program Materials by anyone under age 18 is unauthorized, unlicensed, and in violation of these Terms of Use.

Limited License to You. These Programs, Products, and Services and all Program Materials are the property of Erica Ballard and/or affiliates and licensees, and are protected by copyright, trademark, and other intellectual property laws.

The content in these Programs, Products, and Services is solely owned by or licensed to Erica Ballard unless otherwise indicated. This includes, but is not limited to, the design, layout, look, appearance, and graphics of any Program Materials or other aspects of materials provided to you. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these Terms of Use.

If you purchase or access any Program Materials through these Programs, Products, or Services, you will be considered a Licensee. All content obtained is the property of Erica Ballard. You are granted a revocable, non-transferable license for personal, non-commercial use only, limited to you alone. You may not use these Programs, Products, Services, or Program Materials in a manner that constitutes an infringement of these rights or that has not been authorized.

You do not have permission to publish, record, screenshot, or share any portion of your session publicly. Any recording or detailed document from your session is for your personal use only. For The Download and other group sessions, this same restriction applies to the entire session — recording, screenshotting, or sharing any part of a group session outside of it, including content or comments from other attendees, is not permitted.

Erica reserves the right to refuse service to, or end a session early with, anyone who is abusive, disruptive, or attempting to use a reading as a substitute for medical, psychological, legal, or financial advice in a way that isn't appropriate for the format. No refund is guaranteed in these circumstances.

When you purchase or use these Programs, Products, Services, or Program Materials, personal data and information may be collected — including but not limited to your name, e-mail address, phone number, billing information, credit card or payment information, demographic information, preferences, interests, or other personally identifying information ("Confidential Information"). See the Privacy Policy for details on how this information is collected, used, and protected.

Cancellation and Refund Policy

1:1 Readings ($150): Cancellations or reschedules made at least 48 hours before your scheduled session are eligible for a full refund or reschedule. Cancellations made within 48 hours of the session are non-refundable, but may be rescheduled. Cancellations made within 48 hours due to illness or emergency will be rescheduled at no charge.

No-show appointments will be canceled with no refund given.

If Erica needs to reschedule due to illness or emergency, no refund is provided; you will instead be rescheduled for the next available time.

There are no refunds for issues arising from software, internet, or hardware failure on your end. Rescheduling in this case must be arranged directly with Erica.

The Download (group readings/events): All sales are final. Group event spots are non-refundable, including in the case of no-shows or late cancellation.

Unless otherwise indicated in writing, all fees and charges are in U.S. dollars, and all payments must be made in U.S. currency. No refund or reimbursement will be given for any foreign exchange or currency conversion fee charged by your card issuer.

Booking Information

If you are currently receiving, have previously received, or are currently taking medication for mental health care, you are encouraged to let Erica know before booking your session. This helps ensure the reading is a good fit for where you're at — it is not required, and will not affect your ability to book.

Essential communication about your session will be sent via email. Please double-check that you've entered a working email address when booking — Erica cannot be held responsible for a missed session due to a typo in your contact information.

All live sessions take place over Zoom. You are responsible for downloading, testing, and running any software needed for your session. Zoom is free to download and use. No refund will be given for a missed or disrupted session due to a software, internet, or technical failure on your end. Your confirmation email will contain everything you need to know for your session.

Recordings are not provided by Erica for live Zoom sessions, due to occasional technical issues that can affect them. You're welcome to record audio only on your end, but Erica cannot be held accountable for the quality or completeness of any recording you make. If you're joining from a computer or laptop, Erica can walk you through recording on your end; this isn't available for phone or tablet users.

Sessions cannot be extended past their scheduled end time. If you arrive late, that time is lost — the session cannot run over to compensate. If you experience technical issues during your session, extra time to make up for it is not guaranteed, so it's a good idea to test your Zoom connection ahead of time.

General Provisions

Entire Agreement. These Terms of Use, together with the Disclaimer and Privacy Policy, make up the entire agreement between you and Erica Ballard regarding your use of these Programs, Products, and Services, and supersede any prior discussions, communications, or agreements on the same subject.

Changes to These Terms. These Terms may be updated from time to time. Any changes take effect once posted to this website. Your continued use of these Programs, Products, or Services after changes are posted means you accept the updated Terms.

Severability. If any part of these Terms is found to be unenforceable or invalid, that part will be limited or removed to the minimum extent necessary, and the remaining Terms will stay in full effect.

Governing Law. These Terms, and any dispute arising from them, are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles, consistent with the Disclaimer.
